Charles and Dean - I'm embarassed to say that I just got around to reading this article but it is incredibly thought-provoking, and makes me wonder how clinics or the networks are dealing with the HIM function. Have you revised your information managment policies or standards as a result of EHR functionality? I'll bet this topic would be a great blog post!
We are only beginning to understand this with the laws not really catching up to the technology yet. Also, the new Obama's administration's efforts to spread EMR have also triggered the issue of patient confidentiality and new HIPPA type rules and penalties. This email was sent to me from my Health Information Services Manager (used to be Medical Records Manager).
The Impact of the Stimulus Act on HIPAA
Privacy and Security
March 12
Prod. No. 09xxx0312
On February 17, 2009, President Obama signed the American Recovery and Reinvestment Act (ARRA or PL 111-5) into law as a part of the economic stimulus package. While a large portion of this stimulus package aids the healthcare field by investing significant funds in health information technology, there are a number of new specific requirements related to health information privacy and security that extend and revise the limits of HIPAA. Some of the items affected include data breaches, business associate agreements, and penalties. Attendees will be brought up to speed on the impact of ARRA privacy and security changes and the potential effects on the holders of personal health information.
Who should attend: HIM and IT directors, privacy and security officers, and HIM managers. One can go to this web site to sign up for the training:
